This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Procurement Notices (www.ebrd.com) on 22 December 2015.

Higiena 2009 Ltd (hereinafter referred to as “the Employer”), a company established by the Autonomous Republic of Adjara (“Adjara”) to own and operate the landfill facility, intends to use the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) and an investment grant from the Swedish International Development Agency (Sida) for a project to improve solid waste management services in Adjara.

The Employer now invites sealed tenders from contractors for the following contract to be funded from part of the proceeds of the loan:

Construction of a new sanitary landfill with auxiliary facilities in Tsetskhlauri

Tendering for contracts to be financed with the proceeds of a loan from the Bank and a grant from Sida is open to firms from any country.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

• The Tenderer shall have an average annual turnover as prime contractor over the last five (5) years (i.e. 2011, 2012, 2013, 2014 and 2015) years of not less than EUR 5.5 (five and a half) million equivalent

• The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 4 (four) months, estimated as not less than EUR0.8 million equivalent, taking into account the applicant"s commitments for other contracts.

• The Tenderer shall demonstrate that it has successful experience as prime contractor and has executed at least three (3) projects of a nature and complexity comparable to the proposed contract within the last seven (7) years, each project with no less than 2.700.000 (two million and seven hundred thousand) EUR with issued Employer’s Certificate.

• The Tenderer shall demonstrate that it has following successful specific experience as part of the above three or other contracts:

1. Construction of landfills or dams or road earth works or similar engineered compacted fill bulk earthworks contracts with a minimum fill volume of 50,000 m3 in one contract.

2. Construction of impermeable liner of Bentonite and geotextile requiring welding of joints of at least 20,000 m2.

3. Construction of wastewater or leachate treatment plant with pond system treatment with a minimum flow of 1,000 m3/day and pollution load of 500 kg BOD5/day.

4. Construction of Gas collection or power systems

Contracts to be financed with the proceeds of a loan from the Bank and a grant from SIDA will be subject to the Bank"s Procurement Policies and Rules and will be open to firms from any country. The proceeds of the Bank"s loan will not be used for the purpose of any payment to persons or entities, of for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law of official regulation of the Purchaser"s country.

Upon receipt of appropriate evidence of payment of the non-refundable fee, the documents will promptly be dispatched by courier; however, no liability can be accepted for their loss or late delivery. In addition, if requested, the documents can be dispatched electronically after presentation by the prospective tenderer of an appropriate evidence of payment of the non-refundable fee. In the event of discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.

All tenders must be accompanied by a tender security of EUR 100,000 (one hundred thousand) or its equivalent in another convertible currency or Georgian Lari, calculated at the exchange rate of the National Bank of Georgia on the date of issuing of the security.

Tenders must be delivered to the office at the address below on or before 03 April 2017 at 15:00 local time, at which time they will be opened in the presence of those tenderers’ representatives who choose to attend.
