This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Procurement Notices (www.ebrd.com) on 22 December 2015 and subsequently updated.

Higiena 2009 Ltd (hereinafter referred to as “the Employer”), a company established by the Autonomous Republic of Adjara (“Adjara”) to own and operate the landfill facility, intends to use the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) and an investment grant from the Swedish International Development Agency (Sida) for a project to improve solid waste management services in Adjara.

The Employer now invites sealed tenders from contractors for the following contract to be funded from part of the proceeds of the loan and the grant:

Construction of a new sanitary landfill with auxiliary facilities in Tsetskhlauri

• Survey and design works, including design approval and obtaining of a construction permit;

• Obtaining of an architectural planning assignment, calculations, preparation and approval of detailed design of the Landfill with its internal and external infrastructure including construction of an access road, extension of power and water supply as defined in the technical specification.

• Construction and commissioning of the Landfill, with its internal and external infrastructure, including construction of an access road, extension of power and water supply as defined in the technical specification;

• Preparation of as-built documentation.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

• The Tenderer shall have an average annual turnover as prime contractor over the last five (5) years (i.e. 2012, 2013, 2014, 2015 and 2016) years of not less than EUR 5,500,000 (five million five hundred thousand) equivalent

• The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 4 (four) months, estimated as not less than EUR 800,000 (eight hundred thousand) equivalent, taking into account the applicant"s commitments for other contracts.

• The Tenderer shall demonstrate that it has successful experience as prime contractor and has executed at least 3 (three) projects of a nature and complexity comparable to the proposed contract within the last 7 (seven) years, each project with no less than EUR 2,700,000 (two million seven hundred thousand) confirmed by Employer’s Certificate.

• The Tenderer shall demonstrate that it has following successful specific experience as part of the above three or other contracts:

1. Construction of landfills or dams or road earth works or similar engineered compacted fill bulk earthworks contracts with a minimum fill volume of 50,000 m3 in one contract.

2. Construction of impermeable liner of Bentonite and geotextile requiring welding of joints of at least 20,000 m2.

3. Construction of waste water or leachate treatment plant with pond system treatment with a minimum flow of 1,000 m3/day and pollution load of 500kg BOD5/day.

4. Construction of Gas collection or power systems

Tendering for contracts to be financed with the proceeds of a loan from the Bank and a grant from SIDA will be subject to the Bank"s Procurement Policies and Rules and will be open to firms from any country. The proceeds of the Bank"s loan will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations or under a law or official regulation of the Purchaser"s country.

Tender documents may be obtained from the office at the address below upon payment of a non-refundable fee of EUR 200 or equivalent in another convertible currency or Georgian Lari, calculated at the exchange of the National Bank of Georgia on the date of payment.

Upon receipt of appropriate evidence of payment of the non-refundable fee, the documents will promptly be dispatched by courier; however, no liability can be accepted for their loss or late delivery. In addition, if requested, the documents can be dispatched electronically after presentation by the prospective tenderer of an appropriate evidence of payment of the non-refundable fee. In the event of discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.

A two-stage tender procedure will be adopted and will proceed as follows:

(a) the First Stage tender will consist of a technical proposal only, without any reference to prices, and a list of any deviations to the technical and commercial conditions set forth in the tender documents or any alternative technical solutions a tenderer wishes to offer, and a justification therefor, provided always that such deviations or alternative solutions do not change the basic objectives of the project. Following evaluation by the Employer of the First Stage tenders, the Employer will invite each tenderer who meets the qualification criteria and who has submitted a technically responsive tender to a clarification meeting. The proposals of all such tenderers will be reviewed at the meeting and all required amendments, additions, deletions and other adjustments will be noted and recorded in a Memorandum. Only qualified tenderers submitting a technically responsive and acceptable First Stage tender will be invited to submit a Second Stage tender.

(b) the Second Stage tender will consist of an updated technical tender incorporating all changes required by the Employer as recorded in the Memorandum to the clarification meeting or as necessary to reflect any amendments to the tender documents issued subsequent to submission of the First Stage tender; and the commercial tender.

First Stage tenders must be delivered to the address below on or before September 6, 2017 at 15:00 local time, at which time they will be opened in the presence of the tenderers’ representatives who wish to attend.

All Second Stage tenders must be accompanied by a Tender Security of EUR 70,000 (seventy thousand) or its equivalent in another convertible currency or Georgian Lari, calculated at the exchange of the National Bank of Georgia on the date of issuance, and must be delivered to the address below on or before the time and date of the submission deadline specified in the Letter of Invitation to submit Second Stage tenders, at which time they will be opened in the presence of the tenderers’ representatives who wish to attend.
